Warranty Policy
This Warranty Policy sets out the terms and conditions under which Cobra Systems provides warranty coverage for its certain products. The purpose of this policy is to clearly define the scope of coverage, the obligations of Cobra Systems, and the responsibilities of customers when making a warranty claim. This document is a binding legal policy and must be followed by both Cobra Systems and the customer. It replaces any prior warranty statements or representations, unless otherwise agreed in writing by Cobra Systems.
IMPORTANT NOTICE: PLEASE READ THIS WARRANTY POLICY CAREFULLY. THIS INCLUDES A LIMITATION OF LIABILITY CLAUSE (IN SECTION 22), WHICH LIMITS COBRA SYSTEMS’ RESPONSIBILITY TO THE REPAIR, REPLACEMENT, OR REFUND OF THE DEFECTIVE PRODUCT AS OUTLINED IN THIS POLICY. AND THIS ALSO INCLUDES AN ARBITRATION AGREEMENT IN SECTION 23 BELOW. THE ARBITRATION AGREEMENT REQUIRES YOU TO RESOLVE ALL DISPUTES WITH OUR COMPANY ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCEPTIONS, THROUGH FINAL AND BINDING ARBITRATION.
By purchasing the Product, the Customer agrees to the Warranty’s terms and conditions as a binding agreement between the parties.
- DEFINITIONS:
For the purpose of this Warranty Policy, the following terms must have the meanings set out below:- Claim: A formal request by the customer for warranty service, submitted in accordance with the process set out in this policy.
- Company: Cobra Systems, Inc., a C-corporation with its registered office at 3521 E. Enterprise Dr, Anaheim, CA 92807 (USA).
- Consumables: Components of the printers that are subject to normal wear and tear, including but not limited to print heads, platen rollers, cutters, peelers, batteries, options, internal rewinders, and care label cutters.
- Covered Defects: Manufacturing defects or defects in workmanship that prevent the Product from functioning as intended under normal use.
- Customer: Any person or entity that has purchased a Product covered under this Warranty Policy directly from Cobra Systems or through an authorized distributor or reseller.
- Discontinued Product: A Product or model that Cobra Systems no longer manufactures or supports, at which point the Lifetime Warranty must expire.
- Effective Date: The date on which this Warranty Policy applies, including retroactive application to Cobra branded printers sold on or after January 1, 2014.
- Excluded Issues: Circumstances not covered by this Warranty Policy, including but not limited to accidental damage, misuse, neglect, unauthorized modifications, improper installation, or use of third-party accessories or media.
- Lifetime Warranty: Warranty coverage that applies for the life of the Product, expiring when the specific printer model is discontinued by Cobra Systems.
- Normal Use: Operation of the Product in accordance with Cobra Systems’ instructions, using Cobra branded media, and without misuse, neglect, or unauthorized alterations.
- Premium Vinyl: Cobra branded vinyl products that are specifically listed as covered under this Warranty Policy.
- Printer(s): Cobra branded printers manufactured and sold by Cobra Systems, including but not limited to VnM, Striker, Neo, and Solo models.
- Product(s): Any Cobra branded printers including VnM, Striker, Neo, Solo, and Premium Vinyl covered under this Warranty Policy.
- RMA (Return Merchandise Authorization): The authorization number issued by Cobra Systems that must be obtained by a customer before returning a Product for inspection, repair, or replacement under warranty.
- Standard Warranty: Warranty coverage applicable to consumables and certain parts, generally lasting one year unless otherwise specified.
- Third-Party Products: Products, accessories, media, or components not manufactured by Cobra Systems, which are only covered by the warranty extended by their original manufacturer.
- Warranty: The commitment by Cobra Systems to repair or replace a Product found to have defects in materials or workmanship under the terms and conditions of this policy.
- ACCEPTANCE OF THIS WARRANTY POLICY:
By purchasing or using a Product covered under this Warranty Policy, the Customer acknowledges and agrees to be bound by the terms and conditions set forth herein. The Warranty forms a binding agreement between the Customer and Cobra Systems, and no representative, distributor, or reseller has the authority to modify, extend, or alter the terms of this Warranty in any way. If the Customer does not agree to these terms, the sole remedy is to refrain from purchasing or using Cobra Systems’ Products.
- SCOPE OF WARRANTY:
- Products Covered: This Warranty applies only to Cobra branded printers, including but not limited to VnM, Striker, Neo, and Solo models, as well as Cobra branded vinyl products.
- Defects Covered: The Warranty covers only manufacturing defects and defects in workmanship that prevent the Product from functioning as intended under normal use.
- Retroactive Coverage: Cobra branded printers sold on or after January 1, 2014 are included under this Warranty, subject to the conditions set forth in this policy.
- Warranty Limits: Coverage is limited to the repair or replacement of the defective Product or part, or a refund, at Cobra Systems’ discretion, and is subject to the exclusions and limitations contained in this Warranty Policy.
- WARRANTY DURATION:
- Printers: Cobra branded printers are covered under a Lifetime Warranty, which remains valid for the life of the specific model. The warranty automatically expires once the model is discontinued or no longer supported by Cobra Systems.
- Consumable Parts: Consumables including print heads, platen rollers, cutters, peelers, batteries, options, internal rewinders, and care label cutters are covered under a Standard Warranty of one (1) year from the date of purchase.
- Vinyl Tape: Cobra branded vinyl tapes are covered under a Standard Warranty of one (1) year from the date of purchase.
- Retroactive Application: The Lifetime Warranty for printers applies retroactively to all eligible Cobra branded printers sold on or after January 1, 2014, provided all other conditions of this Warranty Policy are met.
- CONSUMABLES AND EXCLUDED PARTS:
- Consumables: Consumable components of Cobra branded printers, including but not limited to print heads, platen rollers, cutters, peelers, batteries, options, internal rewinders, and care label cutters, are subject to normal wear and tear and are not covered under the Lifetime Warranty. These items are instead covered under a Standard Warranty of one (1) year from the date of purchase, or as otherwise specified in writing by Cobra Systems.
- Excluded Parts: Any part of a Product that fails due to misuse, neglect, unauthorized modifications, or use of non-Cobra media or accessories is excluded from warranty coverage.
- Third-Party Items: Accessories, media, or components not manufactured by Cobra Systems are expressly excluded and are only covered under the warranty provided by their original manufacturer.
- Product Discontinuation: Warranty coverage does not extend to consumables or parts once the Product model is discontinued or no longer supported by Cobra Systems.
- ELIGIBILITY REQUIREMENTS:
- Original Purchase: The Warranty applies only to Products purchased new from Cobra Systems or through an authorized distributor or reseller.
- Proper Use: The Product must be operated in accordance with Cobra Systems’ instructions and under normal use conditions, without misuse, neglect, or unauthorized modifications.
- Approved Media: The Customer must use only Cobra branded media with Cobra printers to maintain warranty coverage. Use of third-party media or accessories voids the Warranty.
- Maintenance: The Product must be maintained in good working condition, free from deliberate damage, improper installation, or evidence of tampering.
- No Unauthorized Repairs: Warranty coverage is void if the Product has been repaired, serviced, or modified by anyone other than Cobra Systems or its authorized service providers.
- Documentation: A valid proof of purchase must be provided when making a warranty claim to establish eligibility under this Warranty Policy.
- COVERED DEFECTS:
- Manufacturing Defects: The Warranty covers defects arising from flaws in the manufacturing process that cause the Product to fail to perform as intended under normal use.
- Workmanship Defects: The Warranty covers defects in workmanship, including assembly or construction errors that prevent the Product from functioning properly.
- Materials Defects: The Warranty covers defects in the materials used in the Product where such defects result in premature failure under normal use conditions.
- Product-Specific Coverage: For printers, coverage applies to the structural and functional components of Cobra branded models, excluding consumables. For Premium Vinyl, coverage applies to manufacturing defects in the vinyl material that impair its intended performance.
- Normal Use Requirement: Defects are only covered when the Product has been operated, stored, and maintained in accordance with Cobra Systems’ instructions and with Cobra branded media, and without misuse, neglect, or unauthorized modifications.
- EXCLUSIONS FROM COVERAGE:
- Accidental Damage: Damage caused by accidents, drops, spills, impact, fire, water intrusion, electrical surges, or other external events is not covered under this Warranty.
- Misuse or Neglect: Any damage or failure resulting from misuse, neglect, abuse, improper handling, or failure to follow Cobra Systems’ operating instructions is excluded from coverage.
- Unauthorized Modifications or Repairs: Defects or failures caused by unauthorized modifications, tampering, or repairs performed by anyone other than Cobra Systems or its authorized service providers are not covered.
- Third-Party Products: Use of third-party accessories, consumables, or media with Cobra branded printers voids coverage. Defects or damage arising from such use are expressly excluded.
- Consumables Beyond Standard Warranty: Consumables including print heads, platen rollers, cutters, peelers, batteries, options, internal rewinders, and care label cutters are excluded from the Lifetime Warranty and are covered only under the one (1) year Standard Warranty.
- Environmental Factors: Damage caused by improper environmental conditions such as excessive heat, cold, humidity, dust, or exposure to chemicals or corrosive substances is not covered.
- Cosmetic Issues: Normal cosmetic wear and tear, including scratches, fading, discoloration, or minor dents that do not affect the functional operation of the Product, is excluded.
- Maintenance Responsibilities: General maintenance, cleaning, and upkeep of the Product, including but not limited to removal of dust, debris, and buildup from print heads, rollers, and cutters, are the sole responsibility of the Customer and are not covered under this Warranty. Failures arising from inadequate maintenance are excluded.
- Product Discontinuation: Warranty coverage ceases when a Product or model has been discontinued or is no longer supported by Cobra Systems.
- Failure to Meet Eligibility Requirements: Any claim where the Customer has not met the Eligibility Requirements in this Warranty Policy, including timely reporting of defects, valid proof of purchase, and compliance with claim procedures, will be excluded from coverage.
- WARRANTY CLAIM PROCESS:
- Initiating a Claim: Customers must submit a written warranty claim through the Cobra Systems website or by email to support@cobrasystems.com, providing details of the defect, proof of purchase, and the Product serial number.
- RMA Requirement: Before returning any Product, Customers must obtain a Return Merchandise Authorization (RMA) number from Cobra Systems. Products returned without a valid RMA will not be accepted.
- Customer Responsibility: The Customer must prepay all shipping and transportation costs for Products returned to Cobra Systems under a warranty claim. Products must be securely packaged to prevent further damage during transit.
- Submission Timeline: Once a Return Merchandise Authorization (RMA) is issued, the product must be returned within thirty (30) business days. Returns received after this period may be refused at Cobra Systems’ discretion.
- Evidence of Defect: Cobra Systems may require photographs, videos, or other reasonable evidence of the defect before authorizing a return.
- Inspection: Returned Products will be inspected by Cobra Systems to determine whether the defect is covered under this Warranty Policy.
- Claim Determination: Cobra Systems will provide a written determination of warranty coverage and proposed remedy within three business days of receiving the Product or sufficient evidence of the defect.
- Denial of Claim: Claims that do not comply with this process or that fail to meet the conditions of this Warranty Policy will be denied.
- SHIPPING AND COSTS:
- Customer Responsibility: The Customer must bear all costs of shipping and transportation for Products returned to Cobra Systems under a warranty claim, including packaging, insurance, and delivery charges.
- Risk of Loss: The Customer is responsible for the safe and secure packaging of the Product. Cobra Systems is not liable for any loss or damage that occurs during transit to its facility.
- Return Shipping: If the warranty claim is approved, Cobra Systems will cover the cost of shipping the repaired or replacement Product back to the Customer using a standard ground service. Expedited or special shipping requests must be paid for by the Customer.
- Non-Covered Claims: If a claim is denied because the defect is excluded from coverage, the Customer must bear all shipping and handling costs associated with the return and reshipment of the Product.
- International Returns: For claims originating outside the United States, the Customer is responsible for all customs duties, taxes, brokerage fees, and other import or export charges in addition to shipping costs.
- RESPONSE TIME:
- Acknowledgement of Claim: Cobra Systems will make reasonable efforts to acknowledge receipt of a warranty claim within five (5) business days of submission.
- Determination of Coverage: Cobra Systems will make reasonable efforts to provide a determination on whether the defect is covered under this Warranty Policy within three (3) business days of receiving the returned Product or sufficient evidence of the defect.
- Repair or Replacement Timeline: If a claim is approved, Cobra Systems will use reasonable efforts to complete the repair or provide a replacement within fifteen (15) business days, subject to the availability of parts and Products.
- Communication: Cobra Systems will attempt to keep the Customer informed of the status of the claim, including any delays or additional information required to process the claim.
- INSPECTION AND DETERMINATION: Upon receipt of a returned Product or sufficient evidence of a defect, Cobra Systems must inspect the Product to verify the reported issue and determine whether it is covered under this Warranty. Cobra Systems alone has the authority to make this determination, and no distributor, reseller, or third party is authorized to do so. The inspection will consider the condition of the Product, its service history, and compliance with the Eligibility Requirements. A written outcome will then be provided to the Customer, confirming approval or denial of the claim and the applicable remedy if approved.
- REMEDIES:
- Repair: If a defect is confirmed under this Warranty, Cobra Systems may repair the defective Product or component using new or refurbished parts that are equivalent in performance and reliability.
- Replacement: Cobra Systems may replace the defective Product or component with the same model or, if unavailable, with a comparable model of equal or greater functionality at its discretion.
- Refund: If repair or replacement is not commercially reasonable, Cobra Systems may provide a refund of the original purchase price, subject to reasonable deductions for use, wear, or depreciation.
- Exclusive Remedies: The remedies of repair, replacement, or refund are the sole and exclusive remedies available to the Customer under this Warranty Policy. Cobra Systems is not responsible for providing any other remedies, including compensation for incidental, indirect, or consequential damages.
- Return of Repaired or Replaced Product: Any repaired or replaced Product will be returned to the Customer at Cobra Systems’ expense using standard ground shipping. Expedited shipping is available at the Customer’s cost.
- No Extension by Replacement: Repair or replacement of a Product under this Warranty does not extend, renew, or restart the original warranty period. The warranty coverage continues to apply only for the remaining balance of the original warranty term.
- Repair Warranty: Repairs performed under this Warranty are covered for ninety (90) days from the date of service or for the remainder of the original warranty period, whichever is longer. Repairs do not extend or restart the original warranty period for the Product.
- DENIAL OF WARRANTY:
- Non-Compliance with Policy: Warranty claims will be denied if the Customer fails to comply with the requirements of this Warranty Policy, including eligibility conditions, use of approved media, or timely filing of claims.
- Excluded Issues: Claims arising from circumstances expressly excluded under this Warranty, such as accidental damage, misuse, neglect, environmental conditions, or use of third-party accessories or media, will not be covered.
- Unauthorized Repairs or Modifications: Claims will be denied if the Product has been repaired, serviced, or modified by anyone other than Cobra Systems or its authorized service providers.
- Insufficient Evidence: Claims will be denied if the Customer fails to provide proof of purchase, the Product serial number, or adequate evidence of the defect.
- Product Discontinuation: Claims related to discontinued Products or models that are no longer supported by Cobra Systems will not be honored.
- Final Determination: Cobra Systems’ decision to deny a warranty claim is final and binding under the terms of this Warranty Policy, subject only to rights provided under applicable law.
- WARRANTY TERMINATION:
- Product Discontinuation: The Lifetime Warranty for Cobra branded printers automatically terminates when the specific model is discontinued or no longer supported by Cobra Systems.
- Transfer of Ownership: Warranty coverage immediately terminates upon the sale, transfer, or assignment of the Product to another individual or entity, as this Warranty is non-transferable.
- Improper Use or Breach of Conditions: The Warranty terminates if the Product is misused, neglected, modified without authorization, operated with non-Cobra media or accessories, or otherwise fails to comply with the Eligibility Requirements.
- Unauthorized Repairs: Warranty coverage is terminated if repairs, servicing, or modifications are performed by anyone other than Cobra Systems or its authorized service providers.
- Failure to File Timely Claim: The Warranty terminates if the product is not returned to Cobra Systems within thirty (30) days of RMA issuance.
- Expiration of Consumables Coverage: The Standard Warranty for consumables and Cobra branded vinyl terminates one (1) year from the date of purchase, unless otherwise specified in writing by Cobra Systems.
- THIRD-PARTY PRODUCTS: Products, accessories, consumables, or media not manufactured by Cobra Systems are not covered under this Warranty. Such third-party products are subject only to the warranty, if any, provided by their original manufacturer. Any defects, failures, or damages to Cobra branded Products caused by the use of third-party items are expressly excluded from coverage under this Warranty Policy.
- FREIGHT DAMAGE:
- Non-Warranty Issue: Damage to Products occurring during shipping is not covered under this Warranty and must be addressed directly with the freight carrier.
- Customer Obligation: Customers must inspect all shipments upon delivery and note any visible damage on the delivery receipt before signing. Any freight damage must be reported to Cobra Systems within three (3) business days of receipt.
- Proof of Damage: Customers may be required to provide digital photographs of the damaged packaging and Product to support the claim with the freight carrier.
- Return Authorization: If Cobra Systems authorizes the return of a damaged Product, the return must be made within thirty (30) days of delivery, and the Product must be packaged securely to prevent further damage in transit.
- Responsibility: Cobra Systems will assist the Customer in coordinating with the freight carrier but is not liable for costs, delays, or losses resulting from freight damage.
- RIGHT TO MODIFY PRODUCTS OR POLICY: Cobra Systems reserves the right, at its sole discretion and without prior notice, to modify, discontinue, or substitute any Product or component, as well as to update, amend, or replace this Warranty Policy at any time. Any changes to the Warranty Policy will apply prospectively to Products purchased after the effective date of the change, unless otherwise required by law.
- NON-TRANSFERABLE WARRANTY: This Warranty is valid only for the original purchaser of the Product and cannot be assigned, sold, or transferred to any subsequent owner, user, or third party. Warranty coverage automatically terminates upon the sale, transfer, lease, or other disposition of the Product by the original purchaser. Any attempt to transfer or assign this Warranty will render it null and void, and Cobra Systems will have no obligation to honor claims made by anyone other than the original purchaser.
- DISCLAIMER OF IMPLIED WARRANTIES: To the fullest extent permitted by applicable law, Cobra Systems disclaims all implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written information, advice, or representation provided by Cobra Systems, its employees, distributors, or resellers will create any warranty not expressly stated in this Warranty Policy. Some jurisdictions do not allow limitations on the duration of implied warranties, so the above limitation may not apply in certain cases. In such jurisdictions, any implied warranties are strictly limited in duration to the period of the express warranties set forth in this Warranty Policy.
- FORCE MAJEURE: Cobra Systems is not responsible for any failure or delay in performing its obligations under this Warranty Policy where such failure or delay is caused by events or circumstances beyond its reasonable control. These events include, but are not limited to, acts of God, natural disasters, fire, flood, earthquake, epidemic, pandemic, explosion, war, terrorism, civil unrest, government action, labor disputes, power outages, supply chain disruptions, or shortages of materials. Force majeure applies to all obligations under this Warranty Policy, including without limitation claim submission timelines, inspection, repair or replacement obligations, and remedy performance. During the continuation of a force majeure event, Cobra Systems’ obligations under this Warranty are suspended, and all applicable deadlines are extended for the duration of the disruption. If the force majeure event continues for an extended period, Cobra Systems may, at its discretion, cancel or modify its obligations without liability, except for refunds or remedies required by applicable law.
- LIMITATION OF LIABILITY: To the maximum extent permitted by applicable law, Cobra Systems’ total liability under this Warranty Policy will not exceed, in the aggregate, the purchase price actually paid by the Customer for the specific Product giving rise to the claim. Cobra Systems is not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages of any kind, including but not limited to loss of profits, loss of business, loss of data, loss of goodwill, downtime, or damage to other property, even if Cobra Systems has been advised of the possibility of such damages. Cobra Systems is not responsible for damages caused by the use of third-party products, accessories, or media, or by delays or failures outside its reasonable control. No representative, distributor, or reseller is authorized to expand or modify this limitation of liability in any way. These limitations apply regardless of the legal theory of liability and continue to apply even if any remedy under this Warranty fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, and in such cases Cobra Systems’ liability will be limited to the maximum extent permitted by law.
- GOVERNING LAW, DISPUTE RESOLUTION, AND MANDATORY ARBITRATION:
- Choice of Law: This Warranty Policy and any disputes arising out of or relating to it must be governed by and construed in accordance with the laws of the State of California, United States, excluding its conflict of law principles.
- Good Faith Resolution: Before initiating legal action or arbitration, the Customer and Cobra Systems must attempt in good faith to resolve any dispute by submitting a written notice of the claim to Cobra Systems at support@cobrasystems.com and engaging in discussions for at least thirty (30) days.
- Agreement to Arbitration: Except as set out in the Exceptions section below, any dispute, claim, or controversy arising out of or relating to this Warranty Policy, including but not limited to warranty coverage, Product performance, or alleged defects, must be resolved exclusively through binding arbitration on an individual basis. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org.
- Class Action Waiver: The Customer and Cobra Systems expressly waive the right to bring or participate in any class, collective, consolidated, or representative action. The arbitrator will have no authority to combine claims or award relief to anyone other than the individual parties to arbitration.
- Delegation: The arbitrator, not any court, must decide questions about the scope, enforceability, or formation of this arbitration agreement, except that courts may decide the enforceability of the Class Action Waiver.
- Exceptions to Arbitration: This arbitration agreement does not apply to (i) individual claims filed in small claims court, provided the claim remains in that court, or (ii) actions seeking injunctive relief to protect Cobra Systems’ intellectual property rights. Any such claims must be brought exclusively in the state or federal courts located in Orange County, California, and the parties consent to the personal jurisdiction of those courts for such matters.
- Location and Language: Arbitration must take place in Orange County, California, unless the parties agree otherwise, and must be conducted in English.
- Arbitrator’s Decision: The arbitrator’s decision is final and binding on both parties, applies only to the dispute at hand, and may be entered and enforced in any court with jurisdiction.
- Fees: Arbitration fees and costs must be allocated according to the AAA Consumer Arbitration Rules.
- Severability: If any portion of this arbitration section is found unenforceable, the remainder must still be enforced to the maximum extent permitted by law.
- MISCELLANEOUS PROVISIONS:
- Headings: Headings in this Warranty Policy are for convenience only and do not affect the interpretation or construction of any provision.
- Binding: This Warranty Policy is binding upon and enforceable against the Customer and Cobra Systems, and it inures to the benefit of their respective successors and permitted assigns.
- Assignment: The Customer must not assign, transfer, or delegate any rights or obligations under this Warranty Policy without the prior written consent of Cobra Systems. Any attempted assignment without consent is void. Cobra Systems may assign its rights or obligations under this Warranty Policy without restriction.
- Survival: The provisions set out in Section 21 (Force Majeure), Section 22 (Limitation of Liability), Section 23 (Governing Law, Dispute Resolution, and Mandatory Arbitration), and Section 24 (Miscellaneous Provisions) will survive the termination, expiration, or completion of this Warranty Policy and remain enforceable to the fullest extent permitted by law.
- Severability: If any provision of this Warranty Policy is found invalid, illegal, or unenforceable, the remaining provisions remain valid and enforceable to the fullest extent permitted by law.
- Entire Agreement: This Warranty Policy constitutes the entire agreement between Cobra Systems and the Customer regarding warranty coverage for the Products and supersedes all prior or contemporaneous written or oral statements, representations, or agreements relating to the same subject matter.
- Waiver: Failure by Cobra Systems to enforce any provision of this Warranty Policy will not constitute a waiver of its right to enforce that provision or any other provision at a later time.
- Acknowledgement by Customer: By purchasing or using a Cobra Systems Product, the Customer acknowledges that they have read, understood, and agreed to be bound by the terms of this Warranty Policy.
